I can safely say I have never downloaded or shared music illegally. I have never bought a recast and I have never downloaded or bought illegal copies of movies. When your a fan of Hi-Def why would you want a crappy picture to watch.:D

Lets look at it this way. A guy is working in the china factory producing these legally for Sideshow. On the side he is also producing castings and selling them on the black market as recasted pieces. If these got onto the market before they began shipping from Sideshow would the people who have no objection to recasting be so forgiving?
 
Ah yes, the old "everybody bends the law sometimes" argument, my favorite. :) That really makes it all ok doesn't it? The fact that I drive 68 mph in a 60 mph zone makes it unfair for me to comment on recasting. Beyond that, it makes it OK to support recasting.

I certainly know I'm no Saint myself, but at least I don't have any illusions about the ethics of what I do. If I get pulled over for speeding I don't tell the officer he has no right to give me a ticket because he downloaded a song from Limewire once.

Once again I'm not trying to tell anyone what to do, I'm nobody's parent here. Just giving my opinion on the matter. I'm not judging anyone here nor do I think anyone here is evil, it's not like I'm holding recasting up on the same level as MURDER. :) Although I have to admit the mentality of Domer's post above is a dangerous one that can technically be applied to any crime under the sun, and it doesn't justify anything.

All that said, I should note that my issues with recasting are less about the legality of it and more about the betrayal to the artist.


I agree Andy. As collectors we should be supporting companies like SS who pay large amounts of money for the Marvel license and to pay sculptors their fees. And then some ass decides to make a quick buck on these cheap recasts. You simply cannot justify it in my book.

What are you talking about? If you are talking about movie props Sideshow is selling then they are doing so through a licence agreement with the original owner of the piece and most likely with studio approval. Big difference.

I'm not talking about the licensed stuff. I'm talking about some of the "fan made" stuff.
 
Can someone please explain to me how recasts have a direct effect on the company or the artist? All of these recasts are on long sold out items. Meaning the company and the artist have all been commisioned accordingly. How does this effect that?

Technically, wasn't this recasted from an original movie prop? Since it was never officially licensed or offered to the public, then it's ok, right.... :angelsmil

I'd like to know how Andy feel about his own sculpts getting recasted here and then ''modified'' then sold to a lot of members here...Was this illegal ? I'd like your honest opinion on it Andy, no needs to censure yourself...Was it ok that your sculpt was modified than sold on this very board?I've got nothing against the guy who did this, I just want to know what the artist thinks of it.

...because the company and artist should also be commisioned for the recast.
 
It would be illegal if there is no license agreement with Universal Pictures. Even the original prop company SWS would need a license agreement to produce these.

It's pretty obvious that no license agreement exists for this particular item and no one seems to have a problem purchasing it. A few members own this bust and everything seems to be ok. :rolleyes:


Whole different story when you recast Bowen or Sideshow product.
 
I made a few comments on the 1:6th Anakin head and got raked over the coals for saying recasting it was wrong and stealing from the artist. I love seeing some people who support the issue willing to be so vocal.
 
Yep, so every 1/1 busts buyers at Statue Forum and people taking commission for a statues , busts,pieces, dont have the licences right to do it, but still do it...

Some of Sideshow's very own sculptors takes illegal commission from private party that end up getting sold in numbers to people from different board...How's that different?

I wonder if Andy got Daniel Craig's permission to make and sell a 1/6 head with his likeness. Just curious. I don't know if that is required or not.

Nothing agaisnt Andy...I like him, but like I said..everyone is guilty.
 
Those were small number private commissioned pieces. There is a huge difference between commissioning a low run (normally below 30 pieces) and mass production (factory level recasting).

In some cases companies actually pick up the commission and produce it as a licensed product.
