How is it not legally mandatory for everyone on a motorcycle to wear a helmet?

I ended up acting as a first responder at a bike wreck today. It was not horrible, but it was not good either. They will live. I've got a weak stomach, and I'm not going to sleep well tonight.

I think it's in Florida where you can get an insurance policy with higher personal injury protection in lieu of wearing a helmet.

In a few other states the statute doesn't define "wear", so you see guys with the helmet attatched to some article of clothing they're wearing. The argument is that they are technically "wearing" a helmet- just not on the head.

And after the so many motorcyclists get into an accident and get a settlement check, guess what they go out and buy.
 
No helmets in Pa. Now I have to wear a seatbelt in my thousands of pounds vehicle with air bags and built in crush barriers. But mr. motor cyclist can choose not to wear his most important safety device. Makes sense doesn't it?

Its about FREEDOM! Anyone who does not want to wear a seat beat or wear a helmet should be allowed to do so......this is America.

BUT with the abundance of evidence that they both save lives and reduce life changing injury, your insurance policy should not cover any injury you receive as a result of not wearing the safety devices readily available.

Plus we get the added bonus of Darwin's award being handed out.

Though I agree with you, there have been many cases of the seat belt not only doing harm, but causing the person's death. Also, there are cases where the seat belt may have been on when the accident occurs, but comes loose or off because of the accident. Who's to say? Insurance companies will then refuse to pay because the seat belt "wasn't on."

There's talk now of forcing adults to wear bicycle helmets. What next? Knee and elbow pads?

Agreed. when Amazon Logistics started delivering my packages, they lost several. I then complained pretty high up the Amazon food chain and got them to note on my account that Amazon Logistics was not to deliver my packages. Fast forward a year and AMZL is now delivering my packages again. So far so good. But I have to laugh because when they drop the package off on the porch, I have seen them take a photo to "prove" they delivered it. What's stopping them from taking it after the photo? :lol

Yeah they've taken pics of my house too. It's not common for them to lose my stuff, but when they do... I always have to buy another one before they'll refund me for the lost one >_>

Issues with seatbelts are generally rare. The issues you raise are likely due to seatbelt misuse or failure. You are far, far safer wearing a seatbelt than not.

And only in a few states is failure to be belted a mitigating factor in damages.

Your larger issue of mandating safety vs personal freedom loses traction for me when the injured party then turns to the govt for care (which happens a TON). At that point taxpayers are paying for his/her poor safety decisions. And we dont have the stomach as a society to simply allow injured people to suffer and/or die.
